PLATFORM TERM OF USE

Have agreed that you have read, understood, and will be bound by the terms of use of the Platform by accessing the website called www.mackolik.com and the mobile site owned by Matchoholic, as well as the Matchoholic Live Scores (mackolik.com) Application as well as any tools offered, including the forum on these websites and the application (collectively referred to as the "Platform”) by viewing or using the Platform. If any of the terms set out in these Terms of Use are not suitable for you, please do not use Platform. Otherwise, these Platform does not accept responsibility for unauthorized and non-juridical capacity use. Matchoholic may make amends to the terms set out herein and all other agreements and information contained on the Platform at any time and without any notice. The amended provisions will take effect on the date of publication. To keep track of these amends, we recommend that you review the terms here at regular intervals.

GENERAL INFORMATION

The platform is managed by the Mackolik İnternet Hizmetleri Ticaret A.Ş. (“Matchoholic”) who is located in Sefikbey Sok. Recep Peker Cd. No.1 34724 Kadikoy/Istanbul.

Users are aware that these Terms of Use (“Terms”) will enter into force for them by visiting and using the Platform, and they are obliged to comply with these Terms during and after accessing the Platform or if they use the services offered on the Platform.

GENERAL PROVISIONS

This Platform is open to everyone provided that it is used in accordance with the provisions of the relevant law. A platform is a place where current sports news content and live results are included on a topic-based and collective basis. All risks arising from the use of the Platform and legal, administrative, and criminal liability belong to the User. For this reason, it is important that Users comply with these Terms and not violate these Terms.

Any material contained in the Platform cannot be published in any other platform or place in any way, including but not limited to written, oral, and/or electronic form. It cannot be used to compete directly and/or indirectly with the Matchoholic. Matchoholic cannot be held responsible in any way directly and/or indirectly for the damages suffered or may be suffered by third parties due to the activities performed by Users on the Platform in violation of these rules. Any request from third parties in this context and damages caused by the User's failure to fulfill the obligations set out in these Terms will be appealed to the relevant User.

It is strictly forbidden for users to make any attempts that may threaten the security of the Platform, prevent the operation of the software that belongs to the Platform, or prevent other users from using the Platform; to impose a disproportionate load on the Platform in such a way as to give these results; unauthorized access to information and content published on the Platform and/or entered by others; to take actions that may threaten the overall security of the Platform and/or harm the Platform and other users; to use software, trying to use or disrupting the operation of all types of software, hardware and servers, causing disruption, interfering with software codes, reverse engineering, arrange attacks, keep busy that will prevent the Platform and the software used from working, or another way to intervene in or trying to gain access to servers.

The user may not engage in behavior that is harmful to others on the Platform (for example, viruses, harassment by stalking, hate speech, support violence against others).

It complies with the law that the database in which the content is accessed and/or viewed through the platform is stored and accessed only to view the relevant content. The accesses made except these are illegal and the necessary claims, lawsuits, and follow-up rights of the Matchoholic are reserved. The Matchoholic may link to other applications and internet sites that are not under its control through the Platform. The Matchoholic shall not have any obligations and responsibilities regarding such services, products, and their contents.

If any of the paragraphs or conditions specified in these terms of use are not suitable for the user, the user may stop using the Platform at any time. Our Matchoholic may modify, suspend, immediately terminate or discontinue access to the Platform for some or all services without prior notice. The User agrees that he/she cannot claim or claim that any harm has been caused for this reason.

The User has agreed and undertaken that he/she will comply with the provisions of these Terms, the law, morality and fairness, and the principles of honesty in all activities that he/she will perform on the Platform.

If Users violate these Terms, engage in behavior that may interfere with the operation of the Platform by any means, including but not limited to those mentioned above, impose disproportionate burdens on the Platform, commit acts that infringe or endanger the rights of third parties, the Matchoholic may temporarily or permanently stop using the Platform of the relevant User. The User cannot have any requests from the Matchoholic regarding these reasons.

CHANGE OF CONDITIONS

Matchoholic reserves the right to change, supplement or renew these Terms and any services, products, information, and contracts available on the Platform without giving any reason and without any notification, reorganize the Platform, and stop broadcasting. There is a current and updated version of the Terms available on the Platform. The user agrees that with the use of the Platform, he/she is dependent on the current version. These Terms of Use cannot be changed by unilateral statements of the user.

INTELLECTUAL PROPERTY RIGHTS

All rights to the software, images, designs, writings, logos, and graphics contained on the Platform belong to the Matchoholic. It is strictly prohibited to copy and/or use the information and/or software used in the design, content, and creation of the database of the Platform, to copy, distribute, process and any other use of all kinds of photos, images, texts, images, files, etc. contained within the Platform. Also, it is strictly forbidden for users to make any attempts that may threaten the security of the Platform, prevent the operation of the software that belongs to the Platform, or prevent other users from using the Platform; to impose a disproportionate load on the Platform in such a way as to give these results; unauthorized access to information and content published on the Platform and/or entered by others; to take actions that may threaten the overall security of the Platform and/or harm the Platform and other users; to use software, trying to use or disrupting the operation of all types of software, hardware and servers, causing disruption, interfering with software codes, reverse engineering, arrange attacks, keep busy that will prevent the Platform and the software used from working, or another way to intervene in or trying to gain access to service providers. The user agrees, declares, and undertakes that solely responsible for the actions/behavior that constitutes a violation of intellectual and/or industrial property rights constitutes a violation, to other users or third parties and/or the user himself, and/or any damage that is occurred to our Matchoholic.

LIMITATION OF LIABILITY

Matchoholic is not liable for any direct or indirect damages caused by entering the platform, using the platform, or the information on the platform and other data, or programs. etc. Matchoholic does not accept any liability for interruption of the transaction, error, negligence, deletion, loss, delay of the transaction or communication, computer virus, or communication error, including but not limited to the following. It has been accepted that the Matchoholic is segregated from any liability including court and other costs, that may arise as a result of entering the platform or linked sites or using the platform, the use /visit of the Matchoholic, as well as for any compensation and claims.

Matchoholic does not guarantee the up-to-date, accuracy, or security of the content on the platform under any circumstances, and assumes no liability for such content. Platform and related contents are provided "as that," with Matchoholic providing no implied claims, including but not limited to implied warranties on the Platform's scope, focused entirely on results, and suitable for a particular purpose. The user agrees that access to the Platform and the services offered within the Platform are widely based on the quality of the service provided by the user's internet service provider, and the Matchoholic is not liable for any problems arising from this quality of service.

DISPUTES RESOLUTION

In all disputes that may arise regarding these Terms, the provisions contained in this text will be applied first of all, and in matters that do not have provisions, Turkish Law will be applied. Istanbul (Caglayan) Courts and Enforcement Offices will be authorized to resolve disputes arising from the application of the Terms.

MISCELLANEOUS PROVISIONS

Matchoholic cannot be made liable for the late or incomplete performance or non-performance of any of its requirements within this Agreement in the event of force majeure and including but not limited to natural disasters, riots, wars, strikes, lockouts, malfunctions caused by telecommunication infrastructure, power outages and bad weather conditions, the actions of the Parties will be suspended during the force majeure period.

If an authorized court or board determines any term of this Agreement invalid or unenforceable, that provision will be replaced with a valid provision that is similar to the Agreement's purpose.
